Commercial & Contractor

Commercial Rental Agreement

This applies when a business rents a trailer to tow and use themselves — you collect it, you haul it, you dispose of the contents, you bring it back. It is a different arrangement from our residential service, and the obligations are considerably heavier.

1Who This Covers

This agreement is between Dump Daddy Trailers LLC ("we", "us") and the business renting the trailer ("you"). It applies to any rental for business, commercial or construction use.

The person signing confirms they are authorised to bind the business, and that the business accepts the obligations below — including the insurance requirements in Section 4 and the release and indemnity in Section 8.

Before You Collect It

We will not release a trailer to a commercial customer until we hold a current certificate of insurance and a copy of the driver’s licence of whoever will be towing it. Both are uploaded when you book. No exceptions — not for a first job, not for a rush job.

2Collection & Return

You collect the trailer from us and you bring it back. We do not deliver it, we do not collect it, and we do not haul or dispose of what you put in it. This is an equipment rental.

We will agree collection and return times with you when you book. Rates for commercial equipment rental are agreed in writing — our published residential prices do not apply, because they include delivery, hauling and disposal you are not buying.

Bring it back on the agreed day, empty, and in the condition you took it. Late returns are charged at the daily rate, and returning it loaded is charged at our disposal cost plus handling.

3Payment

Commercial rates are agreed with you in writing before your first rental. Our published residential prices do not apply — those include delivery, hauling and disposal, none of which you are buying here.

Unless we have agreed billing terms with you in writing, the rental is charged when you book, and we keep a card on file for anything that follows — additional days, damage under Section 8, or a trailer returned loaded.

If we have agreed terms and an invoice goes unpaid, we may suspend further rentals and recover reasonable costs of collection.

4Insurance You Must Carry

Because you are towing our trailer on public roads, your cover has to reach further than it would for equipment that never leaves your site. For the whole rental period you must maintain, at your own cost:

CoverMinimum
Commercial General Liability$1,000,000 per occurrence / $2,000,000 aggregate
Commercial auto liability, covering a non-owned trailer in tow$1,000,000 combined single limit
Physical damage cover for a non-owned trailer in your careEnough to replace the trailer
Workers’ compensationAs required by Idaho law for your employees

Check This One With Your Broker

Confirm your auto policy actually covers a non-owned trailer you are towing. Plenty of policies do not, and finding that out after an accident is the expensive way to learn it. If your cover lapses mid-rental we may require the trailer back immediately.

5Towing Is Your Responsibility

The moment you hitch up, the trailer is on the road under your control, in your vehicle’s care, and on your insurance. That is the single biggest thing you are taking on here, so read this part properly.

If Something Happens On The Road

Any accident, collision, breakdown, citation or roadside incident involving the trailer is your responsibility and your insurance’s, and you must tell us the same day. That includes damage to other vehicles, injury to other road users, and anything spilled from the trailer.

6Check It Before You Tow

Before leaving with the trailer, and again before every trip while it is with you, check:

By towing the trailer you confirm you have checked these and found it roadworthy. If something is not right, do not tow it — call us.

7Care, Custody & Control

From the moment you take the trailer until the moment you hand it back to us, it is in your care, custody and control — on the road, on your site, overnight, at weekends, and whenever nobody is watching it.

You are responsible for securing it, keeping the public away from it, and controlling who has access to it and who tows it.

8Damage To The Trailer

You are liable for any loss of or damage to the trailer while it is in your possession, beyond normal wear from ordinary use. That includes collision damage, theft, vandalism, fire, weather, damage from equipment or vehicles, and damage caused by what is loaded into it.

You will pay the reasonable cost of repair, or the full replacement cost if it is a total loss or is not recovered — plus our lost rental income for the time it is out of service.

Tell us as soon as you know about any damage, loss or theft. Do not attempt repairs yourself.

9Disposal Is Yours

You haul and dispose of the contents yourself, at your own cost, on your own account. Nothing is included.

Illegal Dumping

The trailer is registered to us. If it is used to dump waste illegally, the trail leads to our name. You are fully responsible for any fine, penalty, clean-up cost or enforcement action arising from what you do with the contents, and you will indemnify us for anything that comes our way as a result. This is grounds for immediate termination.

10Injury & Third-Party Claims

Everyone who tows, loads, works around or comes near the trailer does so at their own risk — your employees, your subcontractors, your customers, site visitors, other road users and the public.

You are responsible for injury to or death of any person, and damage to any property, arising from the trailer while it is in your possession — on the road or off it. That includes someone hurt loading it, someone hurt by it in transit, a child getting into it on your site, and damage caused by it or by anything that comes out of it.

You Tell Us Straight Away

If anyone is injured in connection with the trailer, tell us the same day, whatever the apparent severity. Do not admit fault on our behalf, and do not settle anything involving us without our written agreement.

11Release & Indemnity

This is the part your insurer will want to read.

Release. To the fullest extent Idaho law allows, you release Dump Daddy Trailers LLC and its owners, members and employees from any claim, demand or cause of action arising out of your possession, towing or use of the trailer.

Indemnity. You agree to defend, indemnify and hold harmless Dump Daddy Trailers LLC and its owners, members and employees against any claim, loss, liability, damage, fine, penalty, legal fee or cost arising out of:

This survives the end of the rental. It does not extend to loss caused by our own gross negligence or wilful misconduct, and nothing here waives any protection Idaho law says cannot be waived.

Our liability to you is limited to the amount you paid for the rental. We are not liable for indirect or consequential losses — lost time, lost income or project delays.

12Loading & Weight

Never load past the trailer’s weight rating. The rating is on the plate on the trailer. Heavy material reaches that limit long before the trailer looks full — concrete, dirt, rock and shingles fill the weight allowance at roughly a quarter of the visible space.

Load level with the top rail and no higher, spread evenly, and tarp it before you move. An overloaded or overfilled trailer is unsafe to tow and illegal on the road, and any citation is yours.

You are responsible for knowing the combined weight of your vehicle and the loaded trailer, and for staying inside every limit that applies to it.

13Ending A Rental

We may require the trailer back and end the rental immediately if your insurance lapses, if it is towed by someone unauthorised or unfit to do so, if it is being misused or overloaded, if prohibited material is loaded, if it is used for illegal dumping, or if payment fails.

Cancel 12 or more hours before your collection time for a full refund. Inside 12 hours, no refund — the trailer is held for you and turned away from others.

14Idaho Law

This agreement is governed by the laws of the State of Idaho, and any dispute will be handled in the state courts of Ada County, Idaho. If any part turns out to be unenforceable, the rest still stands.

This is the whole agreement for commercial rentals and replaces our residential terms. Any change needs to be in writing.
